A vacancy shall be deemed to occur in the Council upon: the presentation of a written resignation to the Clerk of Council, which resignation shall be effective immediately unless a later time is specified therein; the death of a Councilman; or the determination by the Council that a member of Council ceases to possess or has violated any of the qualifications of the office of Council member, and the removal of such Councilman as provided in Section 11.04 of this Charter. Any vacancy in the Council shall be initially filled by a vote of not less than four members of the Council. If the vacancy is not filled within thirty days after it shall have occurred, the power of Council to fill the vacancy shall lapse and the Mayor shall fill it by appointment immediately following the expiration of said thirty days. Any appointee under this section shall qualify under the provisions of this Charter and shall hold office and serve as a member of Council until whichever of the following occurs first, at which time the appointee’s term in office shall expire and terminate:
A. November 30, following the next regular Municipal election after the vacancy in Council to which he was appointed is deemed to occur under this Charter, provided that if the vacancy occurs within ninety days of the next regular Municipal election this subsection shall not apply.
B. The expiration of his predecessor’s term under this Charter as if the vacancy to which the appointee’s appointment was made had not occurred.
If an appointee’s term in office will terminate in accordance with subsection A. of this section, the balance of his predecessor’s term shall be filled by election at the next regular Municipal election after the vacancy has occurred. Such elected Councilman shall take office on December 1, of the same year of his election and shall serve for a term of two years and until his successor is elected and qualified.
