(A) Every person in possession of land upon which is situated a swimming pool shall at all times maintain on the lot or premises upon which such pool is located and completely surrounding such pool, lot or premises a fence or other structure not less than five feet in height with no openings therein, other than doors or gates, larger than six inches in any dimension; provided, however, that, if a picket or similar fence is erected or maintained, the vertical or horizontal dimension of the openings, other than the gates or doors, shall not exceed six inches.
(B) The design and structural stability shall be in accordance with the Building Code.
