§ 50.13 BURNING OF LANDSCAPE WASTE, REFUSE AND GARBAGE.
   (A)   Except as provided below, it shall be unlawful to burn any garbage, or other organic refuse at any time in the city.
   (B)   It shall be unlawful to burn papers, excelsior, or other material which may be blown about the wind anywhere in the city unless the same is burned in a stove, fireplace, furnace or incinerator sufficiently fine to prevent the escape of ignited particles.
   (C)   Landscape waste which is dry may be burned only when raked into piles of a reasonable size with the wind velocity being less than ten miles per hour and burned between the hours of 10:00 a.m. and 4:00 p.m., and with a person at least 18 years old in attendance to control the fire. Burning leaves and debris must be completely extinguished after 4:00 p.m. No leaves shall be burned upon an asphalt or bituminous surface in any street or alley.
   (D)   In addition to any fine for violation of this section, any person who shall violate this section and cause a response from the Marseilles Fire Protection District, or any other fire district or ambulance service pursuant to a mutual aid call from the Marseilles Fire Protection District shall be required to make restitution to the agency for the costs of that emergency response. The restitution may not exceed $1,000 per public agency for each emergency response.
