(A) Definitions. For purposes of this section the following definitions shall apply unless the context clearly indicates or requires a different meaning.
COMMERCIAL TRUCK. Any motor vehicle, with a trailer or not, if it has one, constructed or used for the transportation of goods, wares, merchandise, crops, livestock, raw materials, or materials which have been processed in excess of 10,000 pounds. COMMERCIAL TRUCK shall not include the following: buses; school buses; fire trucks; other emergency vehicles; motor homes; farm tractors and equipment; utility service vehicles; vehicles used for construction in the village while in the performance of that work; road construction and maintenance equipment, so long as being used for that purpose; and private automobiles and pickup trucks.
TRUCK ROUTE. A road or street on which commercial trucks are allowed and which is designated and posted as a Truck Route.
(B) Designated truck routes.
(1) Commercial trucks shall be operated upon the following routes in the village only, except as otherwise provided in this section: Railroad Street from Highway Street (West 22 Road) to Depot Street.
(2) Commercial trucks (weighing less than 40,000 pounds) shall be operated upon the following routes in the village only, except as otherwise provided in this section:
(a) Railroad Street from Highway Street (West 22 Road) to Marquis Avenue;
(b) Marquis Avenue from Railroad Street to Nebraska Street; and
(c) Nebraska Street from Marquis Avenue to Highway Street (West 22 Road).
(C) Signs; posting. Signs indicating the Truck Route(s) provided herein shall be placed or caused to be placed by the village, or its designee, at the most advantageous points to be conspicuous to approaching vehicular traffic. The signs shall be permanently affixed to a stationery post or installed on permanent buildings or walls. The signs shall in no way be obstructed from view and shall comply with applicable state laws.
(D) Penalty. Any person, firm, corporation or business entity violating this section shall be deemed guilty of a traffic infraction pursuant to § 70.99 of the Nebraska Basic Code and may be fined accordingly.
