ADOPTING ORDINANCE

ORDINANCE NO. 2019-04

   AN ORDINANCE ENACTING TITLE XVII: LOCAL LEGISLATION AS PART OF THE

   VILLAGE CODE OF ORDINANCES FOR THE VILLAGE OF MARQUETTE,

   NEBRASKA; AMENDING, RESTATING, REVISING, UPDATING, CODIFYING AND

   COMPILING CERTAIN ORDINANCES OF THE VILLAGE DEALING WITH THE

   SUBJECTS EMBRACED IN TITLE XVII; AND PROVIDING PENALTIES FOR THE

   VIOLATION OF TITLE VIII.

BE IT ORDAINED BY THE CHAIRPERSON AND BOARD OF TRUSTEES OF THE VILLAGE OF MARQUETTE, NEBRASKA, AS FOLLOWS:

   Section 1. Title XVII: Local Legislation is hereby adopted and shall constitute a part of the Village Code of Ordinances for the Village of Marquette, Nebraska. A copy of Title XVII is attached hereto and incorporated herein by this reference. It is the intention of the Board of Trustees that, in adopting Title XVII, all future amendments and supplements to Title XVII are hereby adopted as if they had been in existence at the time this Ordinance was enacted, unless there is clear intention expressed in Title XVII to the contrary.

   Section 2. Title XVII: Local Legislation as adopted in Section 1 shall consist of the following Chapters:

      170. General Provisions (Reserved)

      171. Administration

      172. Public Works

      173. Traffic Codes

      174. General Regulations

      175. Business Regulations

      176. General Offenses

      177. Land Usage

   Section 3. All prior ordinances, pertaining to the subjects treated in Title XVII, shall be deemed repealed from and after the effective date of this Ordinance, except as they are included and re-ordained in whole or in part in Title XVII; provided, this repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of this Ordinance, nor shall this repeal affect the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory, establishing franchises, or granting special rights to certain persons, authorizing public improvements, authorizing the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal property, granting or accepting easements, plat or dedication of land to public use, vacating or setting the boundaries of streets or other public places; nor shall this repeal affect any other ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by Title XVII. All boards, commissions, councils and other such bodies as established in ordinances or resolutions adopted prior to the adoption of this Title XVII shall continue in existence and number of members unless specifically amended in Title XVII or until an ordinance abolishing, establishing or otherwise changing such bodies is adopted or amended.

   Section 5. This Ordinance adopting Title XVII shall take effect from and after its passage, approval and posting according to law.
