(a) (1) When the Director of Safety and Service, or designated agent, is required to issue a "Notice of Violation" pursuant with Section 551.03, then the Director of Safety and Service, or designated agent, shall charge and collect a fine of fifty dollars ($50.00) and a fifty dollar ($50.00) administration fee for the first offense, fine of seventy five dollars ($75.00) and a fifty dollar ($50.00) administration fee for the second offense, (if committed within twenty-four (24) months of the first offense), and a fine of one hundred twenty-five dollars ($125.00) and fifty dollar ($50.00) administration fee for the third and subsequent offenses (if committed within twenty-four (24) months of the second or subsequent offenses). The fines and fees shall be made payable to the City of Marietta, Ohio, and paid at the Mayor's office, 301 Putnam Street, Marietta, Ohio 45750.
(2) Each fine and fee shall be paid within ten (10) business days from date charged. If the fines and fees are not paid, the fines and fees shall be added to the costs that the City incurs to correct the nuisance violation as per Section 551.05(b) and billed to the property owner. If the bill for said costs plus fines and fees are not paid, a written account shall be made to the County Auditor for amount due and entered upon the tax duplicate and be a lien upon the real estate and be collected as other taxes and returned to the General Fund of the City, as per Section 551.06.

(b) When the Director of Public Safety and Service causes weeds and other undesirable vegetation to be cut or land cleaned of litter, as provided in Section 551.04, a statement of the costs plus fine thereof shall be mailed to the owner of such land by certified mail, return receipt requested. Such statement of cost shall include the following costs to the City:
(1) Administrative and supervision.
(2) Transportation of equipment.
(3) Equipment rental.
(4) Equipment operator.
(5) Incidental labor.
(6) Any fine assessed.
The minimum fee to be charged shall in no case be less than forty dollars ($40.00) for the first hour or portion thereof and thirty dollars ($30.00) for each additional hour or portion thereof.
