(a) Whoever violates the hours of operation set forth in Section 949.03 and 949.04(c) shall be guilty of criminal trespass, a misdemeanor of the fourth degree pursuant to Section 541.05 of the Codified Ordinances, punishable by a fine not to exceed two hundred and fifty dollars ($250.00) and/or imprisonment not to exceed thirty days pursuant to Section 501.99 of the Codified Ordinances.
(b) Whoever violates regulations set forth in Section 949.04(b) shall be guilty of a minor misdemeanor for the first offense, punishable by a fine not to exceed one hundred fifty dollars ($150.00) pursuant to Section 501.99(a)(2)E. of the Codified Ordinances; and a misdemeanor of the fourth degree for any subsequent offense in violation of Section 501.99(a)(2)D. and 501.99(b)(1)D.
