§ 96.21 PERMIT REQUIRED TO REMOVE CERTAIN TREES.
   (A)   Except as may be necessary in furtherance of a community redevelopment project initiated by the village, it shall be unlawful to remove any tree, any greater than 12 inches DBH, whether on public or private property, without first obtaining a village permit, the cost of which shall be determined by the village.
   (B)   Permits will not be issued in the following circumstances, except as allowed in § 96.23:
      (1)   Removal of trees from a tree preservation or no disturbance area such as, but not limited to, the Beech Grove; and
      (2)   Removal of a heritage tree. For purposes of this provision, a HERITAGE TREE is defined as any tree having a 25-inch or larger DBH as defined in § 96.20.
