§ 96.23 PERMITS AUTHORIZING REMOVAL.
   (A)   Issuance of permits. Permits authorizing removal may be issued by the Building Commissioner under the following conditions.
      (1)   The tree is dead or dying.
      (2)   The tree is diseased.
      (3)   The removal of the tree is consistent with established good forestry practices of the Village Arborist.
      (4)   Removal of trees associated with a lot improvement and/or building permit must clearly identify all trees that equal or exceed 25 inches DBH in the front yard, 18 inches DBH in the side yard or 12 inches DBH in the rear yard.
   (B)   Application process.
      (1)   Application will be made to the Building Commissioner’s office with the name, location and size of the identified trees clearly marked on the property location via photographs, site maps or otherwise clearly marked evidence of the specific tree(s) submitted for removal.
      (2)   The application shall include a written statement indicating the reason and need for the removal of the tree, as well as the type, location and size of a replacement tree(s). A written report from a certified arborist shall be required for removal of all heritage trees.
      (3)   Appeals for negative determinations may be made to the Planning Commission and require the same appeal fees as defined in the building permit process.
