1494.10 WARRANTY OF COMPLIANCE.
   In every sale of realty to which this chapter applies, the seller of the property shall warrant, or be presumed to have warranted, that the structure and premises are in compliance with Chapter 115 of the Residential Code of Ohio for all dwelling units, Chapter 34 of the Ohio Building Code for all structures not covered by the Residential Code of Ohio, the Property Maintenance Code, the Zoning Code, and other applicable ordinances of the City at the time of the contract of sale, or unless the seller has provided the buyer with, a document obtained by the Building Commissioner, declaring the property to be violation free, agrees to establish an escrow account as required in Section 1494.09.

1494.11 FORMS, RULES AND REGULATIONS; APPEALS.
   The Building Commissioner is hereby authorized to promulgate such forms, rules and regulations as are necessary for the efficient administration of this chapter. Rights of appeal from the decision of the Building Commissioner are provided for in Section 1440.24.

1494.12 ESCROW AGENT OBLIGATIONS.
   No property owner, property manager, or person, acting in the capacity of a title agent or agency in any real estate transaction, shall transfer title, file any instrument to transfer title, unless the provisions of this chapter have been satisfied.

1494.99 PENALTY.
   (EDITOR'S NOTE: See Section 1440.99 for general Building and Housing Code penalty if no specific penalty is provided.)
   The imposition of the penalty provided in Section 1440.99 or any other penalty provided for in this Property Maintenance Code shall not preclude the Director of Law from instituting an appropriate action or proceeding in a court of proper jurisdiction to prevent an unlawful repair or maintenance, to restrain, correct or abate a violation, to prevent the occupancy of a building, structure or premises, or to require compliance with this Code or other applicable laws, ordinances, rules or regulations, or the orders or determinations of the Building Commissioner, the Director of Safety or the Planning and Zoning Commission.
