(a) Military Training Duty.
(1) Employees who are members of the Ohio National Guard, the Ohio State Guard, the Ohio State Naval Militia or other reserve components of the Armed Forces of the United States, shall be entitled to leaves of absence from their respective duties for such time as they are in the military service on field training or active duty for periods not to exceed thirty-one days in any one calendar year. If an employee's military pay during such a leave of absence is less than his or her City pay would have been for such period, he or she shall be paid by the City the difference between the City pay and his or her military pay for such period. In determining an employee's military pay, allowance for travel, food or housing shall not be considered, but any other pay or allowance of whatever nature, including longevity pay, shall be considered.
(2) An employee wishing to claim the difference between his or her military pay and what his or her normal City pay would have been during his or her leave of absence shall submit a statement of his or her military pay on a form to be provided by the Department of Finance. Such employee shall be placed on official leave with pay pending receipt of his or her statement of military pay as a basis for computation of his or her City pay for the period of his or her official leave. Adjustment to pay shall be made in the pay period in which the employee returns to duty or in no event later than the following pay period.
(3) If an employee wishes to charge the period of absence to vacation or to any time off for overtime due, he or she may do so by making such a request in writing prior to his or her leave, in which case he or she may receive full City pay and military pay for the time absent on vacation or overtime leave.
(b) Jury Duty. Any full-time City employee, while serving upon a jury in any court of record in the County, shall be paid his or her regular salary for the period of time so served, less whatever amount such employee may receive as compensation for his or her services as a juror. Time so served upon a jury shall be deemed active service with the City for all purposes.
(c) Examination Leave. Time off with pay shall be allowed City employees participating in City civil service tests, or taking required examinations pertinent to their City employment before a State or Federal licensing board.
(Ord. 1980-220. Passed 12-17-80.)
(d) Death in Family. Each full-time employee, except those employees covered by a current collective bargaining agreement, shall be entitled to one work day off, if necessary, for attending funeral services for members of his or her family, or up to four work days off, if necessary, for the funeral of a member of the immediate family as defined in Section 260.01(k).
(Adopting Ordinance)
(e) Line of Duty Injury Leave. Line of duty injury leave with pay shall be available to all full-time employees. Awarding of such leave with pay shall be governed by the administrative guidelines in effect at the time of injury. This subsection is hereby made effective retroactive to March 1, 1980.
