149.02 DUTIES AND POWERS.
(a) The Shade Tree Commission shall have the authority to plan, study, investigate, report, advise and recommend to Council any program, action, plan or legislation which it finds or determines to be necessary or advisable for the conservation, care, planting, replanting, trimming, removal or disposition of trees, plants and shrubs in the public ways, streets and alleys, and the Commission shall, when requested by Council, plan, study, consider, make findings and report upon the special request so made. Conservation, care, planting, etc., also may be done in City parks and on private property, primarily to shade public sidewalks, provided that advance written permission is obtained from either the Board of Park Commissioners or the private property owner as applicable.
(b) The Commission shall have the authority to apply for, receive, administer, and enter into agreements regarding grants and donations to be expended, after review and approval of the project by the Public Works Director, in accordance with the purposes set forth in this section by use of City forces or under contract with the City. All funds administered by the Commission shall be accounted for through the City Finance Director's office.
