141.05 RESIDENCY REQUIREMENT.
   (a)   Purpose. The purpose of this residency requirement is to ensure adequate response times by designated sworn employees of the City of Mansfield Fire Department to emergencies or disasters.
   (b)   Definitions.
      (1)   Primary residence: Place where an individual has his or her true, fixed, permanent home and principal establishment, and to which, whenever he or she is absent, has the intention of returning.
      (2)   Sworn employee: Employee required to take an oath before beginning service.
   (c)   Requirement. All full-time, part-time, permanent, and temporary sworn employees of the City of Mansfield Fire Department must establish and maintain their primary residence either in Richland County or in any adjacent county in this state, to-wit: Ashland, Crawford, Huron, Knox or Morrow County. Residency in accordance with the foregoing requirements must be established within eighteen (18) months of the date of permanent appointment. Compliance with the terms of this section is a mandatory condition of continued employment by the City of Mansfield. Any person determined to be in violation of this section by the appointment authority shall be subject to immediate removal from his or her position. In the event the appointing authority fails or refuses to remove the person, the City Finance Director is to withhold all pay and benefits from such person until such removal is accomplished.
   (d)   Exceptions.
      (1)   This provision shall not apply to any employee of the Fire Department hired before January 7, 2013.
      (2)   Except as required by subsection (c) hereof, employees and officials of the City, other than elected official, are generally free to reside anywhere within the State of Ohio.
