1151.04 INTERPRETATION.
(a) This Zoning Ordinance shall be interpreted, whenever an administrative board or the judiciary is called upon to do so, in conformance with the purpose intended to be served by its enactment. The intent of the standards and supporting definitions is to protect both individual property owners and the general public from adverse impacts which might otherwise be the result of a proposed use. To this end, those called upon to interpret this Ordinance shall proceed as follows: determine the public purpose(s) of the standard(s) with respect to which an interpretation is required; determine the actual impact of a proposed interpretation; determine that the proposed interpretation will ensure a just balance between the rights of the landowner and all others who will be affected by that individual land use proposal.
(b) In the interpretation and application, the provisions of this Ordinance shall be held to be the minimum requirements adopted for the promotion of the public health, safety, comfort, convenience or general welfare. It is not intended by this Ordinance to repeal, abrogate, annul or in any way impair or interfere with any existing provision, law or ordinance, or with any rules, regulations or permits previously adopted or issued or which shall be adopted or issued pursuant to the laws and regulations governing the use of buildings or premises; provided, however, that where this Ordinance provides greater restriction than is required by existing ordinances, rules, regulations or permits, the provisions of this Ordinance shall control.
