1129.03 SUBDIVISIONS INVOLVING MORE THAN FIVE LOTS. 
   (a)    Sketch Plan.
      (1)    Before filing an application for conditional approval of the preliminary plan, the subdivider shall submit to the Planning Commission plans and data as specified in Chapter 1131.
      (2)    Within five working days, or within such further time as the applicant may agree to, the Commission acting through its staff shall inform the subdivider that the plans and data as submitted or as modified do or do not meet the objectives of the Code. If the plans and data do not meet the objectives of the Code the staff shall express the reasons therefor.
   (b)    Preliminary Plan.
      (1)    General. On reaching conclusions, informally as recommended in subsection (a) hereof, regarding his general program and objectives, the subdivider shall have prepared a preliminary plan, together with plans and other supplementary material as specified in Chapter 1131.

      (2)    Filing. Five copies of the preliminary plan and supplementary material specified shall be submitted to the Commission with written application for conditional approval and shall be accompanied by a preliminary plan review fee in the amount of thirty dollars ($30.00). If time is not of essence, the subdivider may submit two copies provided he agrees, in writing, to an additional five days beyond the provisions of subsection (b) (3) hereof. (Ord. 91-048.       (3)    Approval. The Commission, with the assistance of the staff, shall within fifteen working days or within such further time as the applicant may agree to, review the preliminary plan and other material submitted for conformity thereof to this Subdivision Code. The. Commission shall recommend to, and negotiate with the subdivider, changes deemed advisable. The staff shall inform the subdivider as to which public offices must be contacted by him to determine the extent and nature of the improvements required by this Code.
         A.    Upon completion of the review, the action, recommendations and negotiation results of the Commission shall be noted on two copies of the preliminary plan, referenced and attached to any conditions determined. One copy shall be retained by the Commission and the other returned to the subdivider.
         B.    Conditional approval of the preliminary plan shall not constitute approval of the subdivision plat. Rather it shall be deemed an expression of approval to the layout as returned to the subdivider, on the preliminary plan as a guide to the preparation of the subdivision plat which will be submitted for approval of the Commission, and for recording upon fulfillment of the requirements of this Code and the conditions of the conditional approval, if any.
      (4)    Improvements. If the subdivider or developer wishes to install his improvements before the subdivision plat is recorded, he shall comply with the requirements of both the preliminary plan and the subdivision plat. Certification by a registered engineer or registered surveyor that improvements have been built to plans and specifications filed with and approved by the engineer of jurisdiction shall then accompany the subdivision plat when submitted for final approval in lieu of plans, profiles and specifications.
   (c)    Subdivision Plat.
      (1)    General. The subdivision plat shall conform to the preliminary plan except where changes are agreed upon between the Commission and the subdivider, and it may constitute only that portion of the approved preliminary plan which the subdivider proposes to record and develop at the time, provided that such portion conforms with all the requirements of this Code.       (2)    Filing. The subdivision plat shall be filed with the Commission not later than twelve months after the date of conditional approval of the preliminary plan and shall be accompanied by a final plat review fee in the amount of fifty dollars ($50.00), otherwise it will be considered void unless an extension is requested by the developer and granted by the Commission. The subdivision plat shall be considered officially filed (submission of the plat for approval) after it has been examined by the staff and reports received from the County Engineer, County Sanitary Engineer, County District Board of Health, where applicable and necessary, and is found to be in full compliance with the formal provisions of this Code. The official filing shall take place at least five working days prior to the meeting at which it is to be considered by the Commission.

      (3)    Submission of plans. After receiving notice of conditional approval of the preliminary plan, the subdivider may proceed to file:
         A.    Six copies of the subdivision plat required under Chapter 1131.
         B.    A written application for approval upon compliance with the formal provisions of this Code. The application form to be provided by the Commission.
         C.    Cross sections and profiles of streets and all other plans, specifications and construction drawings related to the improvements to be constructed in the subdivision as required in this Code. These plans and drawings are to be transmitted to the proper office by the subdivider.
      (4)    Final recommendations. The Commission, together with the other public offices concerned and with the assistance of the staff, shall within fifteen working days of receiving the plans outlined in subsection (c)(3) hereof or within such further time as the applicant may agree to, outline final changes to be made, if any, by the subdivider and notify him of these recommendations.
         Unless consented to by the subdivider, the issuance of final recommendations shall not extend the time limitation imposed by subsection (c) (5) hereof.
      (5)    Commission approval. The Commission shall take action on the final plat, or upon the final plat as amended or changed under the provisions of subsection (c)(4) hereof, in the form of a tracing within thirty days after same has been officially filed, otherwise, such plat shall be deemed to have been approved. The approval of the Commission or refusal to approve shall be endorsed on the plat within thirty days after the submission of the plat for approval, or within such further time as the applicant may agree to, otherwise the plat is deemed approved.
      (6)    Final action. The subdivider shall be notified of the final action of the Commission, and it shall be recorded in the office of the County Recorder within sixty days after the date of approval unless an extension is agreed to by the Commission; otherwise the Commission may recall the plat for its reconsideration. The subdivider shall deposit with the engineer of jurisdiction the estimated recording fee and the original drawing of the final plat, and it shall be recorded by the engineer of jurisdiction and a receipt of Recorder fees sent to the subdivider.
