1111.04 LOTS.
   (a)    General. The lot size, width, depth, shape and orientation shall be appropriate for the location of the subdivision and for the type of development and use contemplated in order to secure and provide for the proper arrangement of streets or other highways in relation to existing or planned streets or highways or to the regional plan for adequate and convenient open spaces for traffic, utilities, access of fire-fighting apparatus, recreation light, air and for the avoidance of congestion of population.
      (1)    Lots shall meet all lawful requirements as adopted by the various governmental subdivisions or public agencies having jurisdiction over this problem.
      (2)    The minimum lot width, at the building line shall be sixty feet.
      (3)    No lot depth shall exceed three and one-half times the lot width.
   (b)    Corner Lots. Corner lots for residential use shall have extra width if necessary to permit an appropriate building setback from and orientation to both streets.
   (c)    Ingress and Egress. The subdividing of land shall be such as to provide each lot with frontage on a public street.
   (d)    Double and Reverse Frontage. Double frontage and reverse frontage lots may be allowed where they are essential to provide separation of residential development from traffic arteries or to overcome specific disadvantages of topography and orientation. A planting screen easement of at least twenty feet, and across which there would be no right of access should be provided along the line of lots abutting such traffic artery or other disadvantageous use. Such easements should be owned and maintained by adjacent property owners but adequately protected through restrictions.
   (e)    Side Lot Lines. Side lot lines shall be substantially at right angles or radial to street lines.
   (f)    Building Setback Lines.
      (1)    Minor streets. No lot shall have a building setback line of less than thirty feet measured from the right-of-way line except for marginal access streets which shall have a minimum setback line of twenty-five feet from the right-of-way line.
      (2)    Secondary, primary and wider streets. The minimum building setback line for all lots fronting upon primary and secondary thoroughfares as designated by the Thoroughfare Plan shall be as follows:
         A.    Secondary roads eighty feet or more in width shall have a minimum building setback line of thirty-five feet measured from the right-of-way line.
         B.    Primary roads 100 feet in width shall have a minimum building setback line of forty feet measured from the right-of-way line.
         C.    The building setback line for all lots fronting on streets or roads having a width of more than 100 feet, such as expressways or super highways, shall be determined by the Planning Commission.
      (3)    Transition. Where a building setback line established under subsection (f)(l) or (2) hereof is more or less than that established on contiguous property on the same street, there may be a gradual transition at the rate of two and one-half feet per lot from the existing to the new.
      (4)    Parcels exempted from platting. Where lots fronting on an existing public street are split or subdivided without a plat, there shall be a building setback line not less than that which would be required if the land were platted.
      (5)    Corner lots. The minimum building setback line on any street not having lots fronting upon it shall be twenty-five feet from the required right-of-way or easement line. Where the street on the side of a corner lot has lots fronting upon it within the same block on the same side of the street, the building setback on the side of the corner lot shall conform to the setback requirements of such street.

   (g)    Zero Lot Line - Common Wall Residences. When zoning regulations permit a lot split for construction of a common wall two family residence with a "zero lot line setback", then the City Engineer shall approve a survey plat of such lot providing said survey plat is attached to the deed and contains information to show compliance with the following requirements:
      (1)    The size of each resulting parcel, no one of which shall be less than 5,200 square feet in area and have a minimum frontage width of thirty-eight feet. Irregular shaped lots shall have a minimum frontage width of thirty-five feet. Frontage in this instance will be measured at the building line.
      (2)    Separate water service lines shall be installed to each unit from the front property line or the side or rear easement line. The service lines shall have a separate curb type shut-off valve for each unit.
      (3)    Separate sanitary sewer laterals to each unit shall be installed using a wye with a clean out to be located at the property line or easement line.
      (4)    Electrical service shall be from a common point and a conduit raceway shall be installed for the conductors serving the unit farthest from the meters.
      (5)    Separate gas lines shall be installed for each unit.
      (6)    An easement shall be provided for the installation of telephone and television cables.
      (7)    No driveways having common ownership shall be permitted.
      (8)    An easement of at least five feet in width for each side of the two family residence shall be provided for maintenance of the common wall.
      (9)    Notice in bold lettering shall advise each owner of the two family residence of the responsibility for common maintenance and insurance for the structure. (Ord. 95-060. Passed 3-21-95.)
