1107.01 DEFINITIONS.
   Unless the context clearly indicates otherwise, the following definitions shall control the interpretation of words used within the Subdivision Code:
   (1)    "Alley" means a public way which affords only a secondary means of access to property abutting thereon.
   (2)    "City" means the City of Mansfield, Richland County, Ohio.
   (3)    "Code" means the Subdivision Code of Mansfield, Ohio.
   (4)    "Commission" or "City Planning Commission" means the Commission which controls the platting of land within the corporate limits of the City or within a distance of three miles of the corporate limits.
   (5)    "Comprehensive (Urban Area) Plan" means the plan adopted by Council and by the Commission and as hereafter amended and supplemented indicating the general locations recommended for the principal streets, parks, public buildings, zoning districts, character and extent of community development and other physical aspects of urban and rural planning on file in the offices of the Clerk of Council and the Commission.
   (6)    "County" means Richland County, State of Ohio.
   (7)    "Developer" means any person, association, partnership, corporation or other legal entity or a duly authorized agent who constructs or contracts to construct improvements on subdivided land.
   (8)    "Easement" means a grant by the owner of the land for the specified use of such land to a corporation, to a partnership, to a person or persons or to the public.
   (9)    "Engineer" means a registered engineer authorized to practice civil engineering as defined in the Ohio Revised Code.
   (10)    "Engineer of jurisdiction" means the City Engineer or other engineer designated by the City.
   (11)    "Flood plain" means that portion of river or creek valley adjacent to the river or creek channel which is covered with water when the river or creek overflows its banks at flood stage.
   (12)    "Improvements" means street pavements, with or without curb or gutter, sidewalks, crosswalks, water mains, sanitary and storm sewers, street trees and other appropriate items.
   (13)    "Lot" means a parcel of land intended for transfer of ownership or building development, having its principal frontage on a public street.
   (14)    "Lot, corner" means a lot abutting upon two or more streets at their intersection.
   (15)    "Neighborhood unit" means a neighborhood development as a district entity adhering to the principle that it should have social homogeneity among its residents and contains its own elementary school, shopping center, churches, clubs, recreation area, and be bounded, not traversed by major traffic arteries.
   (16)    "Official Thoroughfare Plan" means the system of primary and secondary streets as adopted by Council and the Commission, on file in the office of Council and of the Commission, together with all amendments thereto subsequently adopted.
   (17)    "Performance bond", "surety bond" or "property bond" means an agreement by and between a subdivider or developer and a bonding company or personal fidelity or property bond in favor of the City for the amount of the estimated construction cost, and guaranteeing the completion of physical improvements according to plans and specifications within the time prescribed by the subdivider's agreement.
   (18)    "Plat" means a map upon which the subdivider's plan of the subdivision is presented and which he submits for approval and intends to record in the final form.
   (19)    "Reserves" means parcels of land within a subdivision that are intended for future use.
   (20)    "Right of way" means the width, between property lines, of a street, alley, crosswalk or easement.
   (21)    "Setback line, building" means a line indicating the minimum horizontal distance between the center line of the right of way and buildings.
   (22)    "Staff" means the City Engineer and such other personnel as may be designated or provided by the Commission.
   (23)    "Street, arterial" (major, secondary, primary, etc.) means a public thoroughfare which is used primarily for fast or heavy traffic.
   (24)    "Street, collector" means a public thoroughfare which carries traffic from minor streets to the major system of arterial streets and highways, including the principal entrance streets of a residential development and streets for circulation within such a development.
   (25)    "Street, marginal access" means a minor street which is generally parallel and contiguous to an expressway, freeway, parkway, major or minor street and is so designated as to intercept, collect and distribute traffic desiring to cross, enter or leave such traffic artery, and which provides access to abutting properties and protection from through traffic.
   (26)    "Street, minor" means public thoroughfares which are used primarily for access to the abutting properties.
   (27)    "Subdivider" means any person, persons, partnership, association, corporation or other legal entity or duly authorized agent who undertakes the subdivision of land.
   (28)    "Subdivider's agreement" means an agreement by and between a subdivider and/or developer and the Commission (for the City) that sets forth the manner in which the subdivider and/or developer agrees to proceed with the construction of public improvements and the disposition of lots in the subject subdivision.
   (29)    "Subdivision" means:
      A.    The division of any parcel of land shown as a unit or as contiguous units on the last preceding tax roll, into two or more parcels, sites or lots, any one of which is less than five acres for the purpose, whether immediate or future, of transfer of ownership, provided, however, that the division or partition of land into parcels of more than five acres not involving any new streets or easements of access, and the sale or exchange of parcels between adjoining lot owners which does not create additional building sites shall be exempted; or
      B.    The improvement of one or more parcels of land for residential, commercial or industrial structures or groups of structures involving the division or allocation of land for the opening, widening or extension of any street or streets, except private streets serving industrial structures; or
      C.    The division or allocation of land as open spaces for common use by owners, occupants or leaseholders, or as easements for the extension and maintenance of public sewer, water, storm drainage or other public facilities.
   (30)    "Superblock" means a block of exceptionally large size in both dimensions with access to interior lots by cul-de-sacs and loop streets branching in from surrounding streets, and providing one or more open spaces.
   (31)    "Surveyor" means a registered surveyor, as defined by the Registration Act of the State of Ohio.
   (32)    "Width, average" means the distance measured between the mid-point of the side of a lot. When the two sides are not straight, the Commission shall determine the average width. (Ord. 64-222. Passed 9-15-64.)
