951.02 PRIVATE SEWERS RESTRICTED.
No person shall construct in any street or alley a sewer or drain, the cost of which is to be paid otherwise than by assessments upon the lots and lands benefited by the construction thereof, or out of a fund provided by taxation, or by the issuance of bonds, except in pursuance of permission therefor recommended to Council by the Director of Public Service and given by resolution of Council. No person shall be given permission to construct any such sewer or drain until plans, profiles and specifications therefor have been prepared by the Department of Public Service and approved by Council. No excavation shall be made in any street or alley for the construction of any sewer or drain, nor shall any material to be used for the construction of any sewer or drain be deposited therein until there has been executed and delivered by the contractor or other person by whom such sewer or drain is to be constructed, a bond in a sum not less than one thousand dollars ($1,000) to the approval of the Director of Public Service, both as to amount-and sureties, payable to the City, conditioned for the proper construction of such sewer or drain, and for payment to the City for any expense or damage that may result to it by reason of the improper construction thereof, or by reason of negligence of such contractor or person in the prosecution of the work required in the construction of such sewer or drain.
