935.99 PENALTY.
   (a)    Fines.
      (1)    Any discharger that violates any provision of this chapter or any order made thereunder may be fined not more than ten thousand dollars ($10,000) per day per violation. Each day during which each violation continues shall be considered a separate offense.
      (2)    Any person that violates Section 935.03 through 935.07 or any order made thereunder may be fined not more than ten thousand dollars ($10,000) per day per violation. Each day during which each violation continues shall be considered a separate offense.
      (3)    Any person or discharger that violates any provision of this chapter which results in the State or Federal Law taking enforcement actions against the City will be liable for any expense, loss or damage to the POTW in addition to any fines imposed on the City.
   (b)   Recovery of Costs Incurred by the Authority. Any discharger violating any of the provisions of this chapter, or who discharges or causes a discharge producing a deposit or obstruction, or causes damage to or impairs the City's wastewater disposal system shall be liable to the City for any expense, loss or damage caused by such violation or discharge. The City shall bill the discharger for the costs incurred by the City for any cleaning, repair or replacement work caused by the violation or discharge. Failure to pay the assessed costs within ninety (90) days shall constitute a violation of this chapter enforceable under the provisions of Section 935.12.
   (c)    Falsifying Information.
      (1)    No person shall knowingly make any false statement, representation or certification in any application, record, report, plan or other document filed or required to be maintained pursuant to this chapter or with purpose to mislead a public official in performing his official function.
            Whoever violates this subsection (c) (1) is guilty of a misdemeanor of the first degree and shall be fined not more than ten thousand dollars ($10,000) or imprisoned not more than six months, or both.
       (2)    No person shall without privilege to do so, knowingly damage or improperly tamper with any monitoring device or method required or authorized under this chapter.
            Whoever violates this subsection (c)(2) is guilty of a misdemeanor of the third degree and shall be fined not more than ten thousand dollars ($10,000) and imprisoned not more than sixty days, or both.
