935.10 ACCIDENTAL DISCHARGES.
   Each Significant Industrial user (SIU) shall provide protection from accidental discharges of prohibited or regulated materials or substances established by this chapter, or any substance that poses a substantial danger to the public health or welfare or a substantial danger to the environment or of interference or pass through to the POTW. Such protection shall be provided and maintained at the discharger's cost and expense. Detailed plans showing facilities to provide this protection shall be submitted to the City for review, and shall be approved by the City before construction of the facility.
   Construction of any approved facilities shall be completed within six months of notice to provide protection. If facilities are not completed within six months, the City may deny permission to discharge to the sewer system. Review and approval of such plans and operating procedures by the City shall not relieve the discharger from the responsibility to modify its facility as necessary to meet the requirements of this chapter.
   Each SIU shall develop a Slug Discharge Control Plan that details the following information:
   (a)    Description of discharge practices, including non-routine batch discharges;
   (b)    Description of stored chemicals;
   (c)    Procedures for immediately notifying the POTW of slug discharges, including any discharge that would violate a prohibition under 40 CFR 403.5(b), with procedures for follow-up written notification within five days. The notification shall include location of discharge, date and time thereof, type of waste, concentration and volume, and corrective actions. Any discharger who discharges slugs or accidental discharge of prohibited materials shall be liable for any expense, loss or damage to the POTW, in addition to the amount of any fines imposed on the City on account thereof under state and federal law.
   (d)    Procedures to prevent adverse impact from accidental spills, including inspection and maintenance of storage areas, handling and transfer of materials, loading and unloading operations, control of plant site run-off, worker training, building of containment structures or equipment, measures for containing toxic organic pollutants (including solvents), and /or measures equipment for emergency response;
   Signs shall be permanently posted in conspicuous places on the discharger's premises, advising employees whom to call in the event of a slug or accidental discharge. Employees shall instruct all employees, who may cause or discover such a discharge, with respect to emergency notification procedure.
   Each SIU shall notify the City of any significant changes to their operations that might alter the nature, quality, or volume of its wastewater, at least 30 days prior to that change.
   At least every permit cycle, each SIU's spill plan will be evaluated to determine if any changes are needed.
Reporting Accidental Spills
   In the event of a spill of hazardous, toxic, corrosive, explosive, asphyxiant or flammable substances to the atmosphere, storm sewers, or sanitary sewers: The following agencies must be notified immediately upon becoming aware of the discharge.

   Failure to report spills is a violation of this chapter and may result in your facility being fined. (Ord. 16-172. Passed 8-2-16.)
