901.13 OVERHEAD WIRING IN CENTRAL BUSINESS DISTRICT.
(a) No person, firm or corporation shall install or maintain any wires, cables, strands or other equipment for the purpose above, on or over any street, sidewalk or other public place in the Central Business District Streetscape Project area, which area is bounded by Second Street, Mulberry Street, Fourth Street and Diamond Street; provided, however, this prohibition shall not apply to the intersections between streets located within such Central Business District Streetscape Project area and the public alleys known as Luther Place, Library Court and Dickson Avenue.
(b) Any underground wiring, cables, ducts, pipes, conduits or other installations installed beneath the surface of any street, sidewalk or other public place in the Central Business Streetscape Project area shall originate and terminate on the same side of the street to the extent that such installation is reasonably possible in order to minimize the number of lineal feet of the Streetscape Project area which must be opened and repaired.
(c) Nothing in this section shall be construed to prohibit the installation or maintenance of overhead wiring within the Central Business District on a temporary basis in the event of a disruption of services provided by existing underground wiring, as a result of an emergency or caused by a problem in existing underground wiring which cannot reasonably be located or repaired. Such person, firm or corporation shall apply to the Director of Public Service prior to the installation of such temporary overhead wiring and provide a schedule of repairs including the removal of such temporary overhead wiring.
(d) Notwithstanding any provision in this section to the contrary, any wires, cables, strands or other equipment for the purposes mentioned in subsection (a) hereof installed and maintained at the time this section takes effect shall be permitted and will not be in violation of this section. This right to maintain overhead wiring existing on the effective date of this section includes the right to replace an existing supporting strand with one of the same size and the right by a person, firm or corporation, to attach additional cable of wiring to an existing supporting strand owned by such person, firm or corporation so long as the number of supporting strands is not increased.
