515.01 DEFINITIONS.
   As used in this chapter:
   (a)    "Person" includes one or more individuals, partnerships, associations, organizations, corporations, legal representatives, trustees, trustees in bankruptcy, receivers and other organized groups of persons. It also includes, but is not limited to, any owner, lessor, assignor, builder, manager, broker, salesman, agent, employee, lending institution and the City, all other units of local government and any departments, agencies, officers or employees thereof.
   (b)    "Commission" means the Fair Housing Commission created by Section 515.03.
   (c)    "Discriminate" includes to treat an individual or group of individuals differently based on account of race, color, religion, sex, national origin, marital status, age, handicap, familial status or ancestry.
   (d)    "Unlawful discriminatory practice" means any act prohibited by Section 515.02.
   (e)    "Housing accommodations" includes any building or structure or portion thereof which is used or occupied or is intended, arranged or designed to bed used or~occupied or as the home residence or sleeping place of one or more individuals, groups or families whether or not living independently of each other; and any vacant land offered for sale or lease. It also includes any housing accommodations held or offered for sale or rent by a real estate broker, salesman or agent, or by any other person pursuant to authorization of the owner, by the owner or by such person's legal representative.
   (f)    "Restrictive covenant" means any specification limiting the transfer, rental, lease or other use of any housing because of race, color, religion, sex, national origin, marital status, handicap, familial status or ancestry, or any limitation based upon affiliation with or approval by any person, directly or indirectly, employing race, color, religion, sex, national origin, marital status, handicap, familial status or ancestry as a condition of affiliation or approval.
   (g)    "Handicapped person" means any individual who:
      (1)    Has a physical or mental disability which for such individual constitutes or results in a substantial handicap, or
      (2)    The physical or mental impairment substantially limits one or more of such person's major life activities or
      (3)    Is regarded as having such an impairment.
   (h)    "Familial status" means any individual:
      (1)   Under the age of eighteen years being domiciled with a parent or another person having legal custody of such individual, or domiciled with the designee, by written permission, of such parent or other person having custody, or
      (2)    Who is pregnant or is in the process of securing legal custody of any person who is under the age of eighteen years.
   (i)    "Age" means at least forty but less than seventy years, unless indicated otherwise.
   (j)    "Affirmative action" includes, but is not limited to: sale or lease of housing accommodations or restoration thereto; lending of money upon equal terms and conditions; cancellation, recision or revocation of a contract, deed, lease or other instrument transferring any housing accommodation which is the subject of a charge of unlawful discrimination to a person who had knowledge or record notice, prior to the transfer or execution of the agreement to make the transfer, that a charge under Section 515.06 was filed; payment to an injured person of profits obtained by respondent through a violation of Section 515.02; payment for any injury caused by the discriminatory practice; awarding of costs; and a requirement for reports of the manner of compliance.
   (k)    "Dwelling unit" means a residential unit providing complete, independent living facilities for one or more persons occupying a single unit, including permanent provisions for living, sleeping, eating, cooking and sanitation.
   (l)   "Occupancy" means the purpose for which a building or part thereof is used or intended to be used.
   (m)    "Owner" means any person, agent, firm or corporation having a legal or equitable interest in the property.
   (n)    "Neighborhood" means any area or community within the City which has been recognized as such through custom and usage and which may be delineated by recognized boundaries, such as major highways, railroads or rivers and other natural barriers. (Ord. 89-150. Passed 7-5-89.)
