12-2-5: ENFORCEMENT:
The building inspector shall have the power to order all work stopped on the construction, alteration or repair of buildings in the town when such work is being done in violation of any provision or of any ordinance relating thereto. Work shall not be resumed after the issuance of such an order except on the written permission of the building inspector provided that if a stop order is an oral one, it shall be followed by a written stop order within one hour.
Any person who shall continue work in violation of a stop order of the building inspector shall, upon conviction thereof, be punished as set forth in section 1-4-2 of this code. (Ord. 07-002, 2-13-2007)
   A.   If possible, the building inspector will notify a project owner or an agent thereof, of any violation of this chapter, or of any applicable building code by verbal or written notice. If the builder or owner is not on the site, the building inspector shall post such notice at the job site in a conspicuous manner. If the violation is not corrected within forty eight (48) hours of receiving notice, the building inspector shall have the power to order all work on the project stopped as set out in this section.
   B.   If the builder or owner continues to work on the project in violation of the stop work order, the town may pursue legal remedies as set forth in section 50-60-109, Montana Code Annotated.
   C.   Any person served with an order to stop work, who fails to comply with the order not later than thirty (30) days after service or within the time fixed by the building inspector is guilty of a misdemeanor as set forth in section 50-60-110, Montana Code Annotated.
   D.   Any construction started without first obtaining the necessary permits as set forth in section 12-1-2 of this title shall be immediately stopped and no work may continue until such time as the plans have been approved and the necessary permits issued. (Ord. 297, 8-9-2004)
