§ 71.08 CONDITIONS OF PERMIT.
   (A)   Supplemental specifications. The supplemental specifications appearing on the back of the application for this permit, copy attached, and other attached supplemental specifications are herein incorporated as part of this permit.
   (B)   Accident liability and indemnification. Permittee shall well and truly pay for all damages, fines, and penalties for which he or she shall become liable and shall save harmless and indemnify the Village of Manchester and the Village Council, Manchester, Michigan, against all suits, claims, damages, and proceedings of every kind arising out of the operations for work herein.
   (C)   Bonds. The permittee shall before or at anytime during operations, upon demand of this Council, furnish a cash deposit and/or surety bond in such an amount as deemed necessary by this Council to cover damage to this highway. It is understood that the permittee is personally responsible for the conditions of the roads during the operations permitted hereunder, and for the performance of the conditions of the bond, and that all work on the roads will be at the discretion of the Council. If the cost of work exceeds the amount of the bond, the permittee shall be personally liable to the Council for any deficiency. The permittee shall be personally responsible for all damage to the road during the operations permitted hereunder, regardless of the cause of the damage. This Council may retain any portion of the cash deposited herewith which in the opinion of the Council shall be necessary to cover any expense for damage through the granting of the permit and the cash deposit or the balance thereof shall be returned to the permittee upon completion of the work to the satisfaction of this Council. Surety bonds shall be kept in effect by the permittee until released by this Council.
   (D)   Precautions. During the progress of any construction undertaken within the limits of the highway in pursuance hereof, the permittee shall provide all barricades, signs, lights, watchmen, and flagmen as may be required for the safety and convenience of the public in accordance with the Michigan Manual of Uniform Traffic Control Devices, permit attachments and/or as shall seem advisable to this Council. Traffic shall be maintained at all times unless otherwise indicated hereon by special endorsement of the Council’s duly authorized representative. A copy of this permit and the application therefor shall be kept on the site during the course of any construction pursuant hereof by the permittee or his or her duly authorized agent.
   (E)   Environmental conditions. If stipulated in the permit, the permittee agrees to days and hours of pit operations and noise pollution of trucks.
   (F)   Speed/mph of trucks. If stipulated in this permit, the permittee agrees to a maximum speed limit regardless of posted road speed.
   (G)   Violations. The violation of any conditions of this permit by the permittee or his or her material haulers shall constitute a forfeiture of all privileges granted hereunder.
   (H)   Permit revocable. It is distinctly understood that the privileges granted herein are revocable at the will of the Council, and that the permittee acquires no rights in any of the roads, and expressly waives any right to claim damages or compensation of any kind in case this permit is revoked.
