§ 71.04 GENERAL INFORMATION.
   (A)   Special haul route permits will not be issued if, in the opinion of the Council, the requested usage will create hazardous conditions for the traveling public.
   (B)   Among items to be considered as affecting safety are:
      (1)   Location of driveways for sight distance;
      (2)   Interference with other drives and road intersections;
      (3)   Width of haul route road way for 2-way traffic;
      (4)   Dust control on unpaved roads and access drives;
      (5)   The ability of road and its drainage structures to withstand the proposed use;
      (6)   To prevent high levels of noise pollution and diesel fumes pollution;
      (7)   To prevent vibration that may damage homes; and
      (8)   To prevent possible accidents to the citizenry, especially young children.
   (C)   Among items to be considered to preserve the residential qualities of the area are:
      (1)   To preserve the existing zoning and existing traffic;
      (2)   To preserve the quality of family life in a rural area; and
      (3)   To preserve the integrity of Class B roads.
   (D)   A special haul route shall not be required when all of the following conditions are met:
      (1)   When usage falls within the small volume classification for both tonnage and volume of trucks;
      (2)   Will not exceed Class A Road weight limits;
      (3)   The hauling is being done to or from a village business or residence by the most direct route possible from the designated truck routes;
      (4)   When county frost laws are not in effect; and
      (5)   This shall not exempt truckers from obeying any resolutions or ordinances passed by Village Council to limit trucking in specific areas and posted as required by law, such as NO TRUCKS posted on certain designated streets.
   (E)   Special haul route permits will not be issued if, in the opinion of the Council, the adverse environmental impact will be too severe.
   (F)   It is anticipated that in most cases, at the permittee’s expense, some road improvements will be required in connection with the issuance of special haul route permits. The extent of the improvements will depend in part on the requested usage. For this purpose, haul routes will be divided into short-term and long-term haul routes.
