(A) The Manchester Village Council will designate special haul routes by granting permits to allow overweight or excessive volume truck traffic. A special haul route will apply only to the permittee under the permit, and only for the duration of the permit.
(1) The Village Council may, in its discretion, authorize the use of Class B roads to carry Class A loads, and may also authorize the use of any roads for a heavier than normal volume of truck traffic.
(2) A special haul route permit application shall be submitted to the Village Council at least 30 days before the requested effective date of the permit on forms to be furnished by the Village of Manchester.
(3) The application is to be reviewed by the Village Manager and the DPW Superintendent for compliance with the Special Haul Route Ordinance. If the application is not in compliance, applicant is so notified.
(4) All required fees, bonds, and cash deposits must be deposited before a special haul route permit will be issued.
(5) All special haul route permits shall expire on the next May 15 following the date of issuance, unless the terms of the permit shall expressly otherwise provide. In no event shall a permit be valid for more than 1 year from the date of its issuance.
(6) A special haul route permit may be revoked by the Village Council whenever the permittee fails to abide by the terms of the permit.
(7) Unless otherwise specified on the permit, all above-normal maintenance and repair work which the Village Council attributes to the special use of the road by the permittee will be performed by the Village Council with full reimbursement for all materials and equipment used together with time and a half for all labor, and indirect costs and overhead. Billings will be monthly and are to be paid within 15 days, unpaid balance deducted from deposits.
(8) If the permittee's use of the special haul route is expected to continue for several years and, in the opinion of the Village Council, the road is not suitable to handle the anticipated loads and/or volumes, the Village Council may condition the issuance of a permit upon the upgrading of the haul route at permittee's expense.
(9) The permittee shall post a bond (using forms provided), make a cash deposit, pay the permit fee, and submit a certificate of insurance in the amount shown on the approved application, prior to issuance of the permit, a nonrefundable application fee will be charged for new requests to cover review process.
(10) Balance of the permit, administration, and inspection fee must be deposited in accordance with current fee schedule. This payment requirement shall apply only to applications for new haul routes, and not to renewal of existing permits, providing the Village Council determines that sufficient money exists to repair anticipated future damage to the road.
(B) Special haul route permits may be issued for periods up to, but not to exceed, 1 year. All permits shall expire on May 15 of each year, unless otherwise therein specified.
