§ 52.40 WASTING WATER PROHIBITED.
   (A)   When sprinkling, watering or irrigating with water from the municipal water system, care must be exercised to prevent the waste of water.
   (B)   It is unlawful to cause water to overflow from a garden, lawn or boulevard, or to use excessive amounts of water, or to waste water in any other manner.

§ 52.41 UNDERGROUND AUTOMATIC LAWN SPRINKLERS.
   (A)   Requirements. The City Council is hereby authorized to create and amend requirements and specifications for the construction of underground automatic lawn sprinklers in conjunction with the city’s special Underground Automatic Lawn Sprinkler Fund by passage of a resolution of the City Council.
   (B)   “Underground automatic lawn sprinklers” defined. An UNDERGROUND AUTOMATIC LAWN SPRINKLER is defined as any system of pipes and fittings placed underground and designed and constructed in accordance with the requirements and specifications set by resolution of the City Council, with the purpose to sprinkle or irrigate a lawn, garden, trees or boulevard.
   (C)   No liability. The city shall not be liable for any loss arising out of the construction or use of any underground automatic lawn sprinkler to the owner or any third party and any liability shall be the sole responsibility of the owner of the real property or other person who designed, constructed or maintained the underground automatic lawn sprinkler.

§ 52.42 EMERGENCY WATER RESTRICTIONS.
   Emergency water restrictions may be set by resolution if needed.
§ 52.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   Section 52.15 of this chapter will be strictly enforced and, if violated, will subject the offender, on conviction, to a fine of not less than $50.

      (2)   Any person violating § 52.19 of this chapter shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than $500 or imprisoned in the county jail for not more than six months, or by both such fine and imprisonment.

   (C)   If any person performs any act declared unlawful by §§ 52.40 through 52.41 of this chapter, the Public Works Director is authorized and empowered to turn off the water supply to the property being watered or irrigated unlawfully. In order to restore the water supply to such property, a $25 fee must be paid by the owner, tenant, manager or occupant of the property to the City Clerk. Upon payment of the fee, the City Clerk will notify the Public Works Director of such payment who then will restore the water supply to the property.
