The mayor shall give notice of the election which shall be posted at the place where the election is to be held. Said notice shall be posted not later than the 21st day before Election Day. A copy of the notice shall be placed at a public place in each election precinct that is in the jurisdiction of the authority responsible for giving the notice.

It shall be the duty of the city secretary to notify all persons elected, and all newly elected officers may enter upon their duties on the fifth day after the date of the election, excluding Sundays. If any such officer fails to qualify within 30 days after his election, his office shall be deemed vacant, and a new election held to fill the office.

ARTICLE X. GARAGE AND YARD SALES
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Garage sales mean and include all general sales, open to the public, conducted from or on any premises in any residential or nonresidential zone, as defined by the zoning ordinances, for the purpose of disposing of personal property including, but not limited to, all sales entitled "garage," "estate," "lawn," "yard," "attic," "porch," "room," "backyard," "patio," "flea market," or "rummage," or any other sale not for retail. The term "garage sales" does not include the operation of such businesses carried on in a nonresidential zone where the person conducting the sale does so on a regular day-to-day basis. The term "garage sales" shall not include a situation where no more than five specific items or articles are held out for sale and all advertisements of such sale specifically names those items to be sold.
Personal property means property which is owned, utilized and maintained by an individual or members of his residence and acquired in the normal course of living in or maintaining a residence. The term "personal property" does not include merchandise which was purchased for resale or obtained on consignment.

(a) Required. No garage sale shall be conducted unless and until the individuals desiring to conduct such sale obtain a permit from the city secretary. Members of more than one residence may join in obtaining a permit for a garage sale to be conducted at one of the residences.
(b) Procedure.
(1) Application. The applicant or applicants for a garage sale permit shall file a written application with the city secretary at least three days in advance of the proposed sale setting forth the following information:
a. Full name and address of applicant.
b. The location at which the proposed garage sale is to be held.
c. The date upon which the sale shall be held.
d. The date of any other garage sales by the same applicant within the current calendar year.
e. A statement that the property to be sold was owned by the applicant as his own personal property and was neither acquired nor consigned for the purpose of resale.
f. A statement that the applicant will fully comply with this and all other applicable ordinances and laws.
(2) Issuance of permit. Upon the applicant complying with the terms of this article, paying his city garage sale permit in an amount to be established by approval of the city council, the city secretary shall issue a permit.
(c) Conditions. The permit shall set forth and restrict the time and location of such garage sale. No more than two such permits may be issued to one residential location, residence and/or family household during any calendar year. If members of more than one residence join in requesting a permit, then such permit shall be considered as having been issued for each and all of such residences. No more than six permits may be issued for any nonresidential location during any calendar year. The issue of any permits shall be subject to the provisions of the zoning ordinance and its adopted building regulations and no permit shall be issued in violation of these ordinances and/or regulations.
