(A) Pursuant to the authority granted by Laws 1961, Chapter 230, the Offices of Clerk and Treasurer in the City of Madison Lake, Blue Earth County, Minnesota, are hereby combined in the Office of Clerk-Treasurer.
(B) Beginning with the year in which this section becomes effective and each year thereafter, there shall be an audit of the city’s financial affairs by the State Auditor or a public accountant in accordance with minimum auditing procedures prescribed by the State Auditor.
(C) This section is effective upon passage by the City Council.

There is hereby established the position of City Administrator for the City of Madison Lake. This section and duties become effective upon the adoption by the Council.
(A) Qualifications. The City Administrator shall have the same general qualifications for municipal service as other city employees pursuant to city personnel policies.
(B) Appointment. Appointment shall be made by the City Council solely based on executive, administrative, education, and experiential qualifications. Unless otherwise indicated by this section or action of the City Council, the City Administrator shall be subject to any adopted city personnel policy.
(C) Purpose. This section is to provide for a reorganization of the administration of the city so as to provide more clearly the duties and responsibilities of various positions and to make the administration more efficient.
(D) Establishment.
(1) The position of Administrator is hereby established and that person shall be the chief executive officer of the municipality.
(2) The Administrator shall be chosen by a majority of the City Council. Terms, conditions and tenure of employment of that person shall be determined by written contract entered into with the city. The position of City Administrator shall be terminable at the will and pleasure of the City Council.

The duties and responsibilities of the Administrator shall be:
(A) The City Administrator shall be the chief executive officer of the city and shall be responsible to the City Council for the proper administration of the duties set forth in this section and all affairs of the city. Subject to City Council regulations and applicable laws, the Administrator shall control and direct the administration of municipal affairs;
(B) The Administrator shall see that all laws, ordinances and resolutions of the city are enforced.
(C) The Administrator shall supervise the activities of all municipal department heads and personnel of the city in the administration of municipal policy. The Administrator shall recommend the employment and removal of city personnel. The City Administrator shall ensure periodic evaluation and review of all city employees, and scheduling of work;
(D) The Administrator shall attend and participate in all meetings of the City Council;
(E) The Administrator shall be responsible for the preparation of the City Council agenda and recommend to the City Council measures as the Administrator may deem necessary for the welfare of the citizens and efficient administration of the city;
(F) The Administrator shall prepare an annual fiscal budget and capital improvement plan for the City Council. The Administrator shall maintain financial guidelines for the municipality within the scope of the approved budget and capital program. The Administrator shall submit reports to the City Council on the financial condition of municipal accounts and make sure the annual financial statement is prepared in accordance with Minnesota Statutes;
(G) The Administrator shall handle all personnel matters for the city in conjunction with policy established by the City Council. The Administrator shall negotiate or delegate the negotiation of terms and conditions of employee labor contracts for presentation to the City Council;
(H) The Administrator shall represent the city at official functions as directed by the City Council and maintain good public relations with the citizens of the community;
(I) The Administrator shall act as purchasing agent for the city and be responsible in making all purchases in accordance with the approved municipal budget. The Administrator shall have the authority to sign purchase orders for routine services, equipment and supplies for which the aggregate cost does not exceed $5,000. All claims resulting from orders placed by the city shall be audited for payment by the City Council. The Administrator shall negotiate contracts for any kind of merchandise, materials, equipment or construction work for presentation to the City Council;
(J) The Administrator shall coordinate municipal programs and activities as directed by City Council;
(K) The Administrator shall monitor all consultant and contract work performed for the city;
(L) The Administrator shall coordinate the activities of the City Attorney;
(M) The Administrator shall be informed regarding federal, state and county programs which affect the municipality;
(N) The Administrator shall consult with officials of both public and private agencies as may be required;
(O) The Administrator shall inform the City Council on matters dealing with the administration of the city and prepare and submit to the City Council for adoption an administrative code encompassing the details of administrative procedure;
(P) The Administrator shall be required to take an oath of office and shall be bonded at city expense through a position bond which will indemnify the municipality; and
(Q) The Administrator shall perform other duties as may be prescribed by law or required of the Administrator by ordinance or resolutions adopted by the City Council.
