GENERAL PROVISIONS
§ 70.01 AUTHORITY OF CITY TO REGULATE STREETS.
   (A)   The Common Council by ordinance and the Board of Public Works and Safety shall have the authority to restrict traffic on any city street, alley, thoroughfare, or other public place whenever it is deemed to be in the public interest. ('66 Code, § 70.04)
   (B)   The Board or the Common Council shall direct such streets to be posted or otherwise marked so as to show the restricted use of the street. ('66 Code, § 70.05)

§ 70.02 MAXIMUM GROSS WEIGHT LIMITS.
   (A) No vehicles (other than single axle trucks) having a maximum gross weight of ten tons or more, including vehicle and load weight, shall be permitted on any city street.

   (B)   No vehicle, except school buses and emergency vehicles, having a gross weight in excess of five tons, shall use or travel upon Wilson Avenue, south of Clifty Drive; Green Road; or Michigan Road in the city.
      (1)   (a)   As used herein, "VEHICLE" means, except as otherwise provided in this section, a device in, upon, or by which any person or property is, or may be, transported or drawn upon a highway. The term does not include the following:
            1.   A device moved by human power.
            2.   A device that runs only on rails or tracks.
            3.   A wheelchair.
            4.   An electric foot scooter.

         (b)   For purposes of IC 9-17, the term includes the following:
            1.   Off-road vehicles
            2.   Manufactured homes or mobile homes that are:
               a.   Personal property not held for resale; and
               b.   Not attached to real estate by a permanent foundation.
            3.   Watercraft.

      (2) The gross weight limitation imposed by this division (B) shall not apply to any vehicle that has persons, goods, property, or materials to pick up or deliver within the city limits nor shall it apply to commercial vehicles for emergency, school, municipal, or agricultural purposes.

§ 70.03 TRANSPORTATION OF HAZARDOUS MATERIALS PROHIBITED.
   (A)   “HAZARDOUS MATERIAL” shall be defined as provided in IC 13-11-2-96, as presently enacted and/or subsequently included.
   (B)   No vehicle shall transport any hazardous material on Vaughn Drive east of Ferry Street for a distance of 1,000 feet or on West Second Street between McIntyre Street and Madison Avenue. Other than the aforementioned streets, the transportation of hazardous materials which comply with federal, state, and local laws may be permitted elsewhere within the city limits and as permitted on Indiana State Highways 7, 421, 56, and 62.
