For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
APPLICANT. Any person or organization that submits a written request to the County Buildings Committee to assemble at county owned property at a particular time and location for a specified duration of time.
BUILDING. All county buildings, grounds and parking lots located within the boundaries of the county listed in § 54.01.
BUILDINGS COMMITTEE. The Buildings Committee of the County Board.
COMMERCIAL ACTIVITY. An activity whose primary purpose is to obtain a profit for the benefit of an individual, or business entity organized for profit and shall not include the solicitation of donation by anyone during a demonstration, or for charitable purposes, as defined by the Charitable Trusts Act (760 ILCS 55/1 et seq.) and an Act to Regulate Solicitations and Collection of Funds for Charitable Purposes (225 ILCS 460/1 et seq.).
DEMONSTRATION. Demonstrating, picketing, marching, rallying, selling noncommercial printed matter or materials, moving in procession, holding vigils and all other forms of public demonstrative activity that involve the communication or expression whether orally or by conduct, of views or grievances, engaged in by one or more persons, the conduct of which has the effect, intent or propensity to draw a crowd of onlookers within 100 feet of any buildings owned by the county. DEMONSTRATION shall also mean demonstrating, parading, picketing, speech making, holding vigils, sit-ins or other activities, conducted for the purpose of demonstrating approval or disapproval of governmental policies or practices (or the lack thereof), expressing a view on public issues, or bringing into public notice any issue or other matter. However, nothing herein shall be construed to govern lobbyists or lobbying as defined by the Lobbyist Registration Act (25 ILCS 170/1 et seq.), nor shall a DEMONSTRATION mean the peaceful contact or discussions by one or more persons with an elected official during business hours concerning a person’s view on public or personal issues.
GROUNDS. The grassy or garden areas, and shall exclude all parking areas or sidewalks.
INTERFERE or INTERFERENCE. A type of conduct which by its nature tends to hinder, disrupt or obstruct the orderly function of the official enterprises being carried on in a county building or on the land of a county building.
PERMIT. A written request to the County Buildings Committee to assemble at county owned property at a particular time and location for a specified duration of time.
STRUCTURE. Anything built by any person or persons, of any material or substance, for purposes of display, residence or as part of a demonstration. This term shall not refer to anything built pursuant to a state or county contract for construction, remodeling or repair of any state or county property or building.
