12-7-2: AMENDMENTS TO CODE:
Section 101.1: Insert "The village of Lyons, Illinois".
Section 103.1: Shall be amended to read as follows: "The building director shall be the executive official in charge of the regulation and enforcement of this code and shall be known as the code enforcement officer."
Section 106.1: Shall be amended to read as follows: "Prior to the erection, installation, enlargement, alteration, repair, removal, conversion or replacement of a mechanical system, as regulated by this code, a permit must be obtained from the code enforcement officer."
Section 106.3: Shall be amended to read as follows: "A mechanical permit may only be issued to a homeowner for work to be conducted within the homeowner's single-family dwelling, or a licensed mechanical contractor or engineer acting as the building owner's agent. The code enforcement officer is authorized to review the qualifications of permit applicants and to deny permits for just cause."
Section 106.4.4: Delete section.
Section 106.5.2: Insert: "See fee schedule as provided for in subsection 12-2-15B of the Lyons village code."
Section 106.5.3: Delete in its entirety and insert following: "The code enforcement officer shall authorize the refunding of permit fees, upon written request for same, as follows:
      (1)   The full amount of any fee erroneously collected.
      (2)   No more than fifty percent (50%) of a fee collected for which work was not started."
Section 108.4: Delete and substitute with following language: "Penalties shall be as established in section 12-1-5 of the village code."
Section 109.1: Shall be amended to change the number of days from twenty (20) to five (5) business days.
Section 109.2: Shall be deleted and the following substitute language inserted: "Section 109.2 Qualifications. The building board of appeals shall consist of six (6) individuals, one from each of the following professions or disciplines:
      (1)   A registered architect or engineer.
      (2)   An electrical engineer or licensed electrical contractor.
      (3)   A plumbing engineer or licensed plumbing contractor.
      (4)   An HVAC engineer or licensed HVAC contractor.
      (5)   A licensed general contractor or municipal building inspector.
      (6)   A current building or trade inspector for another Illinois jurisdiction.
Each of the above members shall have no less than three (3) years' experience in their respective disciplines. No member shall be a current inspector for the village of Lyons. If a member of one or more of the above disciplines is not available for appointment to the board, members may be appointed from the other listed disciplines."
Section 109.3: Shall be amended to read as follows: "The board shall meet upon notice from the code enforcement officer, within five (5) business days of the filing of the appeal or at stated periodic meetings."
