12-1-5: PENALTIES:
   A.   Any person, partnership, company or other entity who shall violate a provision of this title or who fails to comply with any of the requirements or referenced codes hereof or who shall violate direction issued under the rule making authority of the code enforcement officer, or who shall violate the conditions of a permit, plan or certificate of occupancy, shall be guilty of one or more of the following: (1965 Code § 7-1-4)
      1.   A misdemeanor, punishable by a minimum fine of two hundred fifty dollars ($250.00) and not more than seven hundred fifty dollars ($750.00), and/or imprisonment not to exceed six (6) months. (1965 Code § 7-1-4; amd. 2009 Code)
      2.   A civil infraction, punishable by the following fine schedule:
            First offense: Minimum $50.00/maximum $350.00.
            Second offense: Minimum $350.00/maximum $750.00.
   B.   Civil infractions may be prosecuted in a court of competent jurisdiction or pursuant to an adjudication system as promulgated by the village in accordance with Illinois state statutes 1 .
   C.   Each day that a violation continues shall be deemed a separate offense.
   D.   A court or adjudicator of competent jurisdiction shall have the authority to impose an order providing for daily fines, within the fine schedule promulgated by this chapter, until such time as the violation is abated and verified as such by the code enforcement officer. Such order may be entered as a lien against the property in accordance with Illinois state statutes and may accumulate interest as provided by law. Upon verifying abatement, the code enforcement officer shall cause, where a lien has been recorded, a certificate of compliance to be issued.
   E.   Failure to obtain inspections and inspection approvals as required by this title and under the rule making authority of the code enforcement officer, including, but not limited to, preconstruction inspections, rough inspections, progress inspections, compliance and final inspections, sale and rental inspections, is a violation of this title.
