5-2-1: NUISANCES DECLARED AND ENUMERATED:
   A.   Nuisance Declared: In addition to other sections of this code, each of the acts or omissions in this section is hereby declared to constitute a nuisance. (1965 Code § 9-2-1)
   B.   Creation Or Maintenance Prohibited: It shall be unlawful for any person to cause, create or maintain, or suffer or permit to be created or maintained, any nuisance, or to suffer or permit any such nuisance to exist, or to neglect or refuse to abate the same, or hinder, obstruct or prevent the abatement thereof. (1965 Code § 9-2-2)
   C.   Nuisances Enumerated:
      1.   Offensive Odors: It shall be unlawful to so conduct any business or use any premises as to create an offensive odor which taints the air or renders it unwholesome or disagreeable to the neighborhood. (1965 Code § 9-2-3)
      2.   Offensive Substances: It shall be unlawful to deposit any nightsoil, dead animal or other filthy, offensive or noisome substance upon any lot, street, alley, park or other public place. (1965 Code § 9-2-5)
      3.   Water Pollution: It shall be unlawful to pollute or render unwholesome or impure the water of any drinking hydrant, spring, stream, pond or lake, to the annoyance or prejudice of others. (1965 Code § 9-2-6)
      4.   Obstructing Public Ways: It shall be unlawful to obstruct or encroach upon public highways, private ways, streets, alleys or public places. (1965 Code § 9-2-7)
      5.   Offensive, Filthy Premises: It shall be unlawful to keep or permit to be kept in a foul, offensive or filthy condition any premises. (1965 Code § 9-2-8)
      6.   Garbage, Refuse On Premises: It shall be unlawful for any person, and it is hereby declared to be a nuisance, to permit or suffer any slop, swill, garbage, stable dripping, offal, filth, refuse, animal or vegetable matter which is liable to become putrid, offensive or injurious to health to remain on any premises used or occupied by said person for a longer period than twenty four (24) hours at any one time.       7.   Stagnant Pools: It shall be unlawful and a nuisance for any person to permit stagnant pools to stand on any premises owned or occupied thereby. (1965 Code § 9-2-10)
      8.   Offensive Businesses: It shall be unlawful to erect, maintain or use any building or other place for the exercise of any trade, employment or manufacture which, by occasioning noxious exhalations or otherwise, is offensive or dangerous to the health of individuals or to the public. (1965 Code § 9-2-11)
      9.   Combustible Material Near Buildings: It shall be unlawful to pile or stack any combustible or inflammable material within the space of fifty feet (50') of any building; provided, however, that this shall not apply to materials to be used for building purposes. (1965 Code § 9-2-12)
      10.   Storing Old Automobiles And Junk: It shall be unlawful and a nuisance for any person to store or permit to be stored on any lot, piece or parcel of land any old automobiles, bathtubs, sinks, toilets and other unsightly junk and miscellaneous debris. (1965 Code § 9-2-13)
      11.   Animal Related Nuisances: See the following provisions of this code for animal related offenses:
            Poultry or fowl, subsection 8-1-1B
            Confined animals, section 8-1-7
            Noisy animals, section 8-1-8
            Slaughtering cattle, section 8-1-9
            Animal carcasses, section 8-1-10

      12.   Expectorating: It shall be unlawful to expectorate upon any sidewalk, or upon the floor of any public conveyance, or any building where a considerable number of people gather or assemble together. (1965 Code § 9-2-18)
      13.   Deposit Of Slippery Substances On Public Property: It is hereby declared to be a nuisance and unlawful to place, throw, deposit or drop, or cause to be placed, deposited, thrown or dropped, any peel, rind, slippery substance, nutshells or shucks, fruit, vegetables or refuse upon the floors, stairs, walks, passages or ways of any public hall, place of public amusement, waiting room or station, public building, or school, or in or upon any sidewalk, public way, passageway, crosswalk, alley or curb in the village. (1965 Code § 9-2-19)
      14.   Establishing Cemetery: It shall be unlawful, and it is hereby declared to be a nuisance, to establish a cemetery within the corporate limits or within one mile of the limits of the village. (1965 Code § 9-2-20)
      15.   Tree Roots Obstructing Sewers Or Drains: Any tree or shrub standing or growing on any public street or on private land abutting thereon, whose roots obstruct or interfere with the free operation of any public or private sewer or drain in use is hereby declared to be a nuisance, and subject to abatement as such. Any owner or occupant of any lot or parcel of land abutting on a public street or way, upon which land such tree or shrub shall be standing or growing shall, within ten (10) days after notice from the village president and board of trustees so to do, remove such tree or shrub and the roots thereof. Any person violating this subsection C15 shall be deemed guilty of a misdemeanor. If any such person shall fail to remove such tree or shrub and the roots thereof within fifteen (15) days after notice so to do, the director of public works shall effect such removal at the expense of such owner or occupant.       16.   Traction Engines On Streets: It is hereby declared to be a nuisance for any person to haul, drive, propel or operate any steam or gasoline or diesel traction engine over or through any street, avenue or alley unless the wheels thereof are equipped with treads which will not injure the pavement.
