373.12 RULES FOR MOPEDS.
   (a)   For the purpose of this section, “moped” has the same meaning as motorized bicycle as that term is defined in Section 301.04.
   (b)   The operation of a moped shall be governed by Sections 373.02 to Section 373.09.
   (c)   No person operating a moped shall remove both feet from the pedals or practice or perform any acrobatic riding on any of the streets or public places in the City.
   (d)   The operator of a moped emerging from an alley, driveway, or building, shall, upon approaching a sidewalk or the sidewalk area extending across any alleyway, yield the right- of-way to all pedestrians approaching on such sidewalk or sidewalk area, and upon entering the roadway shall yield the right-of-way to all vehicles approaching on such roadway.
   (e)   No person shall ride a moped upon the sidewalk.
   (f)   No person shall operate a moped:
      (1)   Without due regard for the safety and rights of pedestrians and drivers and occupants of all other vehicles, and so as to endanger the life, limb or property of any person while in the lawful use of the streets or sidewalks or any other public or private property.
      (2)   Without exercising reasonable and ordinary control over such moped.
      (3)   In a weaving or zigzag course unless such irregular course is necessary for safe operation or in compliance with law.
      (4)   Without both hands upon the handle grips, except when necessary to give the required hand and arm signals.
      (5)   At a speed greater than is reasonable and prudent under the conditions then existing.
   (g)   No person shall park a moped upon a street or sidewalk in such a manner so as to obstruct pedestrian or vehicular traffic.
   (h)   No person who is under the age of 18 years, or who holds a motorcycle operator’s endorsement or license bearing a “novice” designation that is currently in effect as provided in Ohio R.C. 4507.13, shall operate a moped on a highway or be a passenger on a moped unless wearing a protective helmet on his or her head, and no other person shall be a passenger on a moped operated by such person unless wearing a protective helmet. Such helmet shall conform with regulations prescribed and promulgated by the Ohio Director of Public Safety. The provisions of this division or a violation thereof shall not be used in the trial of any civil action.
   (i)   Whoever violates any provision of this section is guilty of a minor misdemeanor.
