Anyone who violates this chapter shall be guilty of a minor misdemeanor. If, within one year of an offense, the offender previously has been convicted of or plead guilty to a previous violation of this chapter, whoever violates this chapter is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more prior violations of this chapter, whoever violates this chapter is guilty of a misdemeanor of the third degree.
