(a) Inspection programs performed by the City of Loveland may be established on any reasonable basis, including but not limited to: routine inspections; random inspections; inspections based upon complaints or other notice of possible violations; inspection of drainage basins or areas identified as higher than typical sources of sediment or other contaminants or pollutants; inspections of businesses or industries of a type associated with higher than usual discharges of contaminants or pollutants or with discharges of a type which are more likely than the typical discharge to cause violations of state or federal water or sediment quality standards or the NPDES storm water permit; and joint inspections with other agencies inspecting under environmental or safety laws. Inspections may include, but are not limited to: reviewing maintenance and repair records; sampling discharges, surface water, groundwater, and material or water in drainage control facilities; and evaluating the condition of drainage, erosion, and sediment control facilities and other storm water treatment practices.
(b) All erosion and sediment control measures on the site shall be inspected at least once every seven calendar days and within one work day after any storm event greater than one-half inch (½) of rain per twenty-four (24) hour period. The site owner shall assign qualified inspection personnel to conduct these inspections to ensure that the control practices are functional and to evaluate whether the ESC Plan is adequate, or whether additional control measures are required. Qualified inspection personnel are individuals with knowledge and experience in the installation and maintenance of sediment and erosion controls. The City or its assigned shall conduct inspections of erosion and sediment controls on active construction sites at least once every thirty-one (31) days, or as needed in response to violation correction.
These inspections shall meet the following requirements:
(1) Disturbed areas and areas used for storage of materials that are exposed to precipitation shall be inspected for evidence of or the potential for, pollutants entering the drainage system.
(2) Erosion and sediment control measures identified in the ESC Plan shall be observed to ensure that they are operating correctly.
(3) Discharge locations shall be inspected to determine whether erosion and sediment control measures are effective in preventing significant impacts to the receiving waters.
(4) Locations where vehicles enter or exit the site shall be inspected for evidence of off-site vehicle tracking.
(5) Utilize OEPA or other inspection checklists as approved by the City to document observations.
(c) A final construction inspection by the City of Loveland is required before the release of any performance securities can occur.
(d) The site owner shall maintain for three (3) years following the final stabilization of the site a record summarizing the results of these inspections, names(s) and qualifications of personnel making the inspections, the date(s) of inspections, major observations relating to the implementation of the ESC Plan and a certification as to whether the facility is in compliance with the ESC Plan and identify any incidents of non-compliance.
