926.26 MAINTENANCE COVENANTS.
   (a)   Maintenance of all storm water management facilities shall be ensured through the creation of a formal maintenance covenant that must be approved by the City of Loveland and recorded as a stand-alone document, on the deed and on the record plat prior to final plan approval. As part of the covenant, a schedule shall be developed for when and how often maintenance will occur to ensure proper function of the storm water management facility. The covenant shall also include naming the responsible party for maintenance and repair, equipment, skills or training necessary to perform the work. Provisions for the periodic review and evaluation of the effectiveness of the maintenance program and the need for revisions or additional maintenance procedures shall be included in the plan.
   (b)   The City of Loveland, in lieu of a maintenance covenant, may accept dedication of any existing or future storm water management facility for maintenance, provided such facility meets all the requirements of this chapter, is determined by the City Manager to be in the best interest of the City, and includes adequate and perpetual access and sufficient area, by easement or otherwise, for inspection and regular maintenance.
