This chapter applies to and requires a Storm Water Management Plan from soil disturbing activities of all development or redevelopment applications equal to or greater than one (1) acre in size, or land which is a part of a larger common plan of development or sale on one (1) or more acres of land, unless eligible for an exemption or granted a waiver by the City of Loveland under the specifications below:
(a) Any logging, cemetery, or agricultural activity which is consistent with an approved timber management plan or a soil conservation plan prepared or approved by the OEPA, as applicable.
(b) Developments that do not disturb more than one acre of land, provided they are not part of a larger common development plan;
(c) Repairs to any storm water treatment practice deemed necessary by the City of Loveland.
(d) Provisions are made to manage storm water by an off-site facility. The off-site facility is required to be in place, to be designed and adequately sized to provide a level of storm water control that is greater than or equal to that which would be required by on-site practices and there is a legally obligated responsibility for long term operation and maintenance of the storm water practice.
