155.16 SEVERANCE.
   Upon separation from employment for any reason, an employee shall receive compensation for all hours worked or credited but unpaid, and any unused vacation credit, but shall not be compensated for unused flextime. Computation shall be at the rate of pay in effect on the employee's last date of work except that compensation for accrued but unused compensatory time off must be at the employee's regular rate at the time of separation, or the average of the regular rate over the final three years of the employee's service, whichever is provided, as provided in the FLSA. Such payment, at the employee's discretion, may be deferred for up to one year after the employee's departure from City service. In the event of an employee's death, such payment shall be made directly to the employee's beneficiary, or estate if no beneficiary is named.
