953.03 DUTIES OF HOUSEHOLDERS AND PERSONS IN CONTROL OF COMMERCIAL, INDUSTRIAL, INSTITUTIONAL, AND APARTMENT BUILDINGS.
   (a)   No householder or person in control of or responsible for the operation of any commercial, industrial, institutional, or apartment building or establishment shall dispose of, bury, burn, or dump any garbage within the City, except as otherwise provided by this code or by other applicable ordinances of the City.
   (b)   No householder or person in control of or responsible for a commercial, industrial, institutional, or apartment building shall permit the accumulation in or on any premises of any garbage or rubbish, except as provided in this division, or as provided in subsections (d) and (e) hereof.
      (1)    Garbage shall be drained of all liquids and wrapped in papers.
      (2)    Garbage and rubbish shall not be placed in the same container, but shall be placed in separate metal or plastic watertight containers of not more than 20 gallons capacity, which shall have close-fitting lids. Containers used for garbage shall be washed and disinfected as often as necessary to prevent nuisances of the type described in Section 953.09.
      (3)    Rubbish may be contained in boxes, provided such boxes are of sufficient strength and size to contain such rubbish.
      (4)    No container for garbage or rubbish shall be filled to exceed fifty pounds in weight, except as provided in subsection (e) hereof.
   (c)   On the day or days for collection designated by the City Manager in accordance with this chapter, it shall be the duty of each householder to place the containers in which garbage and rubbish has been accumulated on the ground level of the premises at a place readily accessible to and for the collector, and immediately adjacent to, but not within, the travel portion of a street or alley, not earlier than 6:00 p.m on the day preceding such day. Such containers shall be removed by the householder on the same day after collection has been made.
   (d)   Commercial, industrial, institutional, and apartment buildings and establishments shall provide for the removal and disposal of garbage and rubbish accumulated on their premises at proper intervals so as to prevent the creation of a nuisance such as that described in Section 953.09.
   (e)   All persons, firms, and corporations in control of or responsible for the operation of commercial, industrial, institutional, and apartment buildings within the City shall be required to provide for such buildings their own private garbage and rubbish containers. All persons, firms, and corporations in control of or responsible for the operation of commercial, industrial, and institutional buildings within the City shall, in addition, be required to provide for such buildings their own private garbage and rubbish collection and disposal services.
      (1)    The number and size of the garbage and rubbish containers shall be of adequate size and with adequately secure lids or covers so as to prevent spillage or wind-scattering of their contents, as well as unsightly or odorous conditions.
      (2)    The locations of all garbage and rubbish containers shall be screened on three sides with a solid, opaque fence material so as to create a visual and wind barrier. Such screening shall extend from the ground to three feet above the height of the container or containers. The fourth side may be kept open for access to such containers, and shall, wherever practical, face away from view from adjoining premises and streets.
      (3)    No garbage or rubbish container shall be set closer than twenty feet from any adjoining public right-of-way or any adjoining property line, or at any other location than within a side or rear yard as such terms are defined by the Zoning Code of the City.
   (f)   All plans for new construction of commercial, industrial, institutional, and apartment buildings submitted to any department or agency of the City for approval shall show the proposed location on the premises in question of all garbage and rubbish containers, the number of the containers, and the proposed screening of the containers, all in conformity to the provisions of this section.
