(a) The Safety Director is authorized to accept donations of trees from adjacent property owners for planting within right-of-way of streets within the City.
(b) Any adjacent property owner wishing to have a tree planted within the right-of-way of the street upon which his property abuts shall apply to the Safety Director for a permit, which shall be issued by the Safety Director at no cost, and shall be issued in accordance with the restrictions and regulations provided in this section.
(c) All such trees shall be planted in the utility strip adjoining the roadway and shall be placed so as not to obstruct or restrict ingress or egress from the adjoining property. Planting of such trees shall be in accordance with planting recommendations kept on file in the office of the City Manager and provided to any resident interested in planting trees on the street right-of- way. The planting recommendation shall be based on suggestions and recommendations from urban foresters or other individuals with similar expertise.
(d) All such trees within the street right-of-way shall be the maintenance responsibility of the adjoining property owner in accordance with good nursery practice. This duty of maintenance shall be binding on all subsequent owners of the adjoining property after the initial planting of the tree.
(e) The City Manager's office shall keep on file and provide to any resident interested in planting trees on the street right-of-way a listing of all trees permitted to be planted, along with the minimum strip width and minimum spacing for tree planting. The list may be modified from time to time as new species of trees are developed and as new areas are added to the City. The list of trees and additions or deletions to the list will be based on suggestions and recommendations from urban foresters or other individuals with similar expertise.
