§ 38.61 BOARD OF DIRECTORS DESIGNATED.
   (A)   There is hereby created pursuant to KRS 67C.147(3), a Louisville Urban Services District Board of no more than five members, one member appointed by the Mayor and four members appointed by the Council, all of whom shall be residents of the District and shall serve a two-year term. The Council may only appoint persons that reside in Council Districts, which have a portion of their territory that lie within the District. The Council appointments from the Council Districts that lie within the District will be made in the following order:
      (1)   First two-year terms: For the first two-year terms of the District Board, the Council will appoint a resident from each of the following Council Districts: 4, 6, 8, and 9.
      (2)   Second two-year terms: For the second two-year terms of the District Board, the Council will replace the members directly above (such as, first two-year terms) by appointing a resident from each of the following Council Districts: 1, 3, 5, and 10.
      (3)   Third two-year terms: For the third two-year terms of the District Board, the Council will replace the members directly above (such as, second two-year terms) by appointing a resident from each of the following Council Districts: 15, 18, 21, and 26.
      (4)   Fourth two-year terms: For the fourth two-year terms of the District Board, the Council will replace the members directly above (such as, third two-year terms) by appointing a resident from each of the following Council Districts: 11 and 25. The Council will also select two additional residents from any Council District that has territory that lies within the District.
   (B)   Thereafter, the Council appointments will continue to be made in the order as set forth above. However, if any Council District after redistricting no longer has any territory that lies within the District, then, if applicable, it shall be replaced, upon approval by the Council, by a Council District that was previously not in the District but since has gained territory that lies within the District. In the event a Council District's appointment can not be replaced by another Council District, then the appointment belonging to a Council District that no longer has territory within the District will be made by the Council from one of the remaining Council Districts which has territory that lies within the District.
