Any such person found to be in violation of any portion of § 34.005 of this chapter, with the exception of subsection (A)(6), shall be summarily dismissed and shall not be employed under these rules for a period of one year thereafter; provided, however, that should the appointing authority fail or refuse to dismiss, the Board shall conduct a hearing which the accused person may attend with counsel; if the Board finds the accused guilty of violation of this rule the Board shall dismiss the violator with a consequent one year disqualification. Such action of the Board is final. Any such person who shall be found in violation of § 34.005(A)(6) may be suspended but shall not be subject to the summary dismissal provisions of this rule. Any employee so suspended is entitled to a hearing as provided in these rules.
