(a) In case any applicant has been denied a license, or if their license has been revoked or suspended, the applicant or licensee, as the case may be, shall be granted an automatic appeal to City Council from the denial, revocation or suspension. Notice of the appeal date shall be given to the applicant or licensee a minimum of 5 days before the hearing. Any applicant who does not attend their appeal hearing, or notify City Council in writing that they will be unable to attend, shall be deemed to have waived their appeal. The Deputy City Clerk shall notify all members of City Council of the time and place of such hearing. Three members of City Council shall constitute a quorum to hear such appeal. The appellant may appear and be heard in person or by a self-designated council. If, after the hearing, a majority of all members of City Council declare in favor of the applicant, the license shall forthwith be issued or fully reinstated, as the case may be; otherwise the order appealed from shall become final.
(b) Appeal of this suspension may be perfected by submitting a written notice within 10 days of the issuance of the suspension served upon City Council through its Clerk, 215 South Mill Street, Louisville, Ohio 44641. City Council shall set a time and place for a hearing on the issue of the suspension. The license will remain suspended during the review process. (Ord. 15-48. Passed 12-21-15.)
