1302.10 BOARD OF BUILDING APPEALS; APPEALS FEE.
   (a)   Council to Establish. Council shall provide for the organization and maintenance of a Board of Building Appeals. This Board shall consist of five residents of the City appointed by Council. The appointive members shall be appointed for terms of five years except that of the five members first appointed, one shall be appointed for a term of one year, one for a term of two years, one for a term of three years, one for a term of four years and one for a term of five years.
   In the event of a vacancy on the Board, Council shall within thirty days, appoint a new member who shall have the same qualifications as the member whom he replaces and who shall serve the balance of the unexpired term of the member.
   (b)   Organization. The Board shall organize by electing a chairman, vice chairman and a secretary, who shall serve for a period of one year. The Building Inspector or his representative shall attend all meetings of the Board and shall provide such information, services and assistance as it may require.
   A quorum shall consist of three members and no official meetings shall be held unless a quorum is present at roll call.
   The affirmative vote of the majority of the members present at a meeting shall be necessary to pass any resolution or make any decision.

   (c)   Rules and Procedures; Appeal Fee. The Board shall adopt rules and regulations of procedure, which it may, from time to time, change at its discretion; provided, however that no rule or regulation shall be in conflict with any provision of the foregoing subsection (b) hereof.
   These rules and regulations shall fix the time and place of regular meetings and shall provide for special meetings, for appeal procedure and for such other matters as are pertinent to the operation of the Board. The Appeal Fee shall be established by inclusion in the City of Louisville’s fee schedule.
   Complete minutes shall be kept of every meeting, setting forth all business transacted and decisions made. In case an appeal is adverse to the appellant, the minutes shall contain the reason therefor. All minutes shall be signed by the secretary. A copy of the minutes shall be sent to the Building Inspector. The appellant shall be given a copy of the action taken in his case.

   (d)   Powers and Duties. For the purpose of carrying out the intent and purpose of this Residential Building Code, the Board shall have the following powers and perform the following duties:
      (1)   To hear an appeal filed by any person or company adversely affected by a decision of the Building Inspector in the enforcement of this Code, and to determine whenever, in the opinion of the Board, such decision shall be reversed, modified or affirmed and the Board shall have the power and authority to require by resolution that the Building Inspector modify, reverse or enforce his decision.
      (2)   To formulate and report to Council, from time to time, recommendations for action by them upon such amendments to the Code as the public health, safety and development of arts and science may require.
      (3)   To determine by rule or regulation, on application to the Board, whether any new type of material, method of construction or equipment is equal to that required by the Code, and to recommend the use of new material incorporation in the Code.
