(a) Except as provided in this section, the design and construction requirements of this chapter shall not apply to any water recreation facility that was constructed prior to the effective date of this chapter in accordance with the design and construction requirements of the ordinance in effect at the time construction was completed (hereinafter referred to as an “existing facility”) and that continues to meet those requirements.
(b) The design and construction requirements of this chapter shall apply to the remodeling of an existing facility unless the Director determines, in writing, that alternate requirements, including, but not limited to, the design and construction requirements in effect at the time of construction shall apply to the remodeling of the existing facility.
(c) The Director shall order reasonable modifications to the design or construction of an existing facility if he/she finds that any condition exists that endangers the health or safety of the facility's patrons or personnel.
