839.10   GENERAL PREREQUISITES TO ADVERTISING OR CONDUCT OF SALE.
   Any person or retail business that advertises a going out of business sale shall conspicuously include in the advertisement the permit number assigned for the sale by the Commissioner of the Revenue and the effective dates of the sale as authorized in the permit. It shall be unlawful for any person or retail business to conduct or advertise to conduct a sale to induce or attempt to induce the public to purchase or otherwise acquire an interest in goods, wares or merchandise at a going out of business sale by means of any publication or advertisement in a newspaper, magazine, book, notice, handbill, poster, circular, pamphlet, letter, billboard, sign, radio or television broadcast, internet or any other manner unless the retail business seller has a valid permit pursuant to this Chapter and in fact and in good faith intends to go out of business.
