It shall be unlawful for any person, either as a principal or as an officer or agent of another, or retail business to advertise or conduct a sale for the purpose of discontinuing a retail business located in Loudoun County, or to modify the word “sale” in any advertisement with the words "going out of business" or any other words which tend to insinuate that the retail business is to be discontinued and the goods, wares or merchandise liquidated, unless such person or retail business obtains a valid permit issued by the Commissioner of the Revenue to conduct such sale. The permit will be valid within Loudoun County, outside of any of the County's incorporated towns. If a retail business has validly obtained a going out of business permit from the incorporated town within Loudoun County where such retail business is located, there will be no need to obtain a similar permit from the Commissioner of the Revenue of Loudoun County. For purposes of this Chapter, the Commissioner of the Revenue includes his designee.
