If an employee does not timely file the request as provided for in this chapter, or if, after having filed such request, he fails to establish that he did not violate the provisions of this chapter, he shall thereby be considered to have abandoned and terminated his appointment or employment and shall no longer hold such position or be entitled to any of the rights or emoluments thereof.
